Terms of Service

These Terms of Service ("Terms") govern your use of the Olli mobile application (the "App"), operated by thethink.app ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Not Medical Advice

Olli is not a medical device and does not provide medical advice. The sleep plans, recommendations, and information provided through the App are for general informational and educational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult your pediatrician or a qualified healthcare provider with any questions about your child's health or sleep. Never disregard professional medical advice or delay seeking it because of information provided by the App. If your child is experiencing a medical emergency, call your local emergency services immediately.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the App. By using the App, you represent that you meet this requirement.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App's systems or other users' accounts
  • Interfere with or disrupt the App's infrastructure
  • Reverse-engineer, decompile, or disassemble the App
  • Use the App to collect or harvest information about other users
  • Upload malicious content or attempt to exploit vulnerabilities
  • Use the App in a way that could harm or endanger a child

5. Co-Parenting & Shared Access

If you invite another user to share access to a baby profile, you are responsible for ensuring that person is an authorized caregiver for the child. You acknowledge that shared users will be able to view and modify sleep data associated with the shared profile.

6. Intellectual Property

The App, including its design, features, content, and underlying code, is owned by thethink.app and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Service Availability

We strive to keep the App available and functioning, but we do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice.

8. Account Termination

You may delete your account at any time through the App settings or by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the App, other users, or third parties.

9. Limitation of Liability

To the fullest extent permitted by applicable law, thethink.app and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use of the App.

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless thethink.app from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or your violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other appropriate means. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
